End-User License Agreement
Effective September 4, 2026.
This End-User License Agreement (“EULA”) is between SmileMaxer LLC and the person or practice using the PerioMaxer mobile apps, today for iPhone, iPad, and Android, the PerioMaxer office desktop for Windows, and the standalone or Office Linked capabilities they provide (together, the “Software”).
1. License grant
Subject to any applicable platform-store license, active trial or paid subscription, and compliance with this EULA, SmileMaxer LLC grants the user or subscribing practice a limited, non-exclusive, non-transferable, revocable license to install and use the Software for periodontal record-keeping. Office Linked subscription use is limited to the one physical practice location covered by the plan.
The Software is licensed, not sold. For copies obtained from the Apple App Store or Google Play, the license and usage rules supplied by that store also apply and take precedence over conflicting provisions here. This EULA does not replace a license presented with your store purchase.
2. Plan limits
Installation and use are limited by the plan’s office-computer, registered-mobile-device, location, and simultaneous-session limits. An active seat means one simultaneous charting session, not a named person or fixed public IP address.
An office computer is licensed by signing in to the software on that computer with the practice account. No separate key or activation code is issued or required.
The practice may revoke and replace registered office computers and mobile devices through the account portal, subject to the applicable plan limit. Revoking an office computer takes effect immediately and ends its access and active charting sessions. Self-service computer deactivation is limited to once every seven days per practice; the portal shows the next available date. A computer registration slot is separate from a simultaneous charting seat.
3. Restrictions
You may not:
- register office computers or mobile devices, use physical locations, or run simultaneous charting sessions beyond the purchased plan;
- copy or distribute the Software except for authorized practice installations;
- reverse-engineer, disassemble, decompile, or derive source code except where applicable law expressly permits;
- modify or create derivative works of the Software;
- remove proprietary notices or bypass licensing, update verification, pairing security, or other technical controls;
- rent, sublicense, resell, or provide the Software as a service to another practice without written permission.
4. Updates
The Software may check for signed updates from the PerioMaxer cloud service. Some updates may be required for security, protocol compatibility, PMS compatibility, or legal reasons. Continued use may depend on installing a required update.
5. Local system access
The office-desktop Software runs on Windows only. The practice authorizes it to interact with the PMS and operating-system input controls selected during setup. The practice is responsible for ensuring it has the right to use its PMS, workstation, local network, and configured automation workflow in this manner.
6. Record-keeping tool
THE SOFTWARE RECORDS AND TRANSFERS VALUES ENTERED BY A DENTAL PROFESSIONAL. IT DOES NOT DIAGNOSE, INTERPRET CHARTED VALUES, RECOMMEND TREATMENT, OR REPLACE PROFESSIONAL REVIEW OF THE OFFICIAL RECORD.
Voice recognition and network transfer can produce errors. Automated entry into the practice-management chart can also produce errors. When PMS entry is used, the dental professional must verify every entry in the PMS before finalizing the record.
7. Ownership
SmileMaxer LLC and its licensors retain all right, title, and interest in the Software, documentation, trademarks, and related intellectual property. No rights are granted except those expressly stated in this EULA.
8. Termination
This license ends when the trial or subscription ends or if the practice materially breaches this EULA. On termination, the practice must stop using and uninstall the office-desktop Software and remove office enrollment from devices no longer authorized.
9. Disclaimers and liability
The disclaimers, limitation of liability, and governing-law provisions in the Terms of Service apply to this EULA.
